Abstract

This paper describes the progress made in the five years since the Supreme Court ruling in Olmstead v. L.C. Drawing on the body of research and analysis that has developed since the ruling, the paper presents an overview of the Americans with Disabilities Act (ADA) and the significance of this for the community integration of people with disabilities. It goes on to describe the Olmstead decision and the legal framework underpinning the Supreme Court decision. Finally, the paper examines activity since Olmstead (what the authors call it’s “legacy”), including the litigation it has influenced and the implications it has had on policy and practice in public programs, particularly the Medicaid program, summarizing the situation in 5 states as illustration.
