Fox-Grage, W., Folkemer, D., & Lewis, J. (2003) The States’ response to the Olmstead decision: How are states complying? National Conference of State Legislators.

Abstract

The purpose of this report was to update earlier versions to follow states’ compliance with Olmstead. It provides great details about how each state is planning on complying with Olmstead amidst budget crisis.

This report categorizes current Olmstead implementation activities, including legislative initiatives, structural changes and implementation barriers across the states. The product of a survey, carried out in collaboration with the AARP, this report gives information and contact details for each state and state plan.

It makes conclusions about (1) state budgets, (2) federal grants ("perhaps the most promising development", noting that all states except Arizona and South Dakota have received them and they have helped maintain some activity as budgets have decreased), (3) state legislation (for example, it notes that 3 state have legislated on consumer directed services), (4) lawsuits, (5) planning, (6) taskforces, (7) state plans and oversight.
